By signing a rental request, the customer (referred to below as the Tenant) offers Tobago Sunrise (referred to below as the Agent) the binding completion of a hiring contract. Subject to this contract is the temporary tenancy of a holiday accommodation in Tobago. The Agent is acting as a broker between the Tenant and management of the accommodation (referred to below as the Accommodation).
The rental request is effected when the rental request has been received by the Agent.
The contract comes into existence when the Agent has indicated that the offer has been accepted - either in person, by telephone, in writing or by email. After the prepayment was received by the Agent or the Accommodation, the Tenant will receive a confirmed booking. Terms of prepayment, payment of the balance and cancellation-policy depend on the guidelines of each Accommodation.
The Agent is obligated to provide the Tenant with proper intermediary agent services as well as to fulfill the resulting obligation to take due care, to provide information and consulting services. However, the Agent is neither liable for the provision of the contractual obligations of the Accommodation nor for service defects involving the third party services that he has procured.
The Agent is not liable to the Tenant for consulting errors that are the result of false information about the rental property provided by the Accommodation. The Agent will provide the Tenant with name, address and contact number of the Accommodation if requested.
